全体被征收人:

依据《中共清流县委办公室 清流县人民政府办公室关于成立清流县城区旧城改造征迁工作指挥部的通知》(清委办发明电〔202239号)文件精神,拟对清流县原县长途客运站-建筑公司片区改造项目红线图范围内的所有房屋实施征收(具体以征收红线图为准)。房屋征收部门已拟定该项目房屋征收补偿安置实施方案征求意见稿(详见附件)。现根据国务院《国有土地上房屋征收与补偿条例》(国务院令第590号)、《福建省实施〈国有土地上房屋征收与补偿条例〉办法》(省政府令第138号)、《关于调整清流县机关事业单位经营性资产市场租赁价格的通知》(清财资〔20154号文件)等相关法律法规、规章及规范性文件的规定予以通告征求意见。若有反馈意见,应持本人身份证明和房屋权属证明在征求意见期限内以书面形式提交,征求意见期限为2022817日至2022916日止。

清流县原县长途客运站-建筑公司片区改造项目国有土地上房屋预征收补偿安置实施方案

(征求意见稿)

 

依据《中共清流县委办公室 清流县人民政府办公室关于成立清流县城区旧城改造征迁工作指挥部的通知》(清委办发明电〔202239号)文件精神拟对清流县原县长途客运站-建筑公司片区改造项目实施征收。为确保项目顺利实施,根据国务院《国有土地上房屋征收与补偿条例》(国务院令第590号)、《福建省实施〈国有土地上房屋征收与补偿条例〉办法》(省政府令第138号)、《关于调整清流县机关事业单位经营性资产市场租赁价格的通知》(清财资〔20154号文件)等相关法律法规、规章及规范性文件的规定,特制定清流县原县长途客运站-建筑公司片区改造项目国有土地上房屋预征收补偿安置实施方案。

 

第一部分   总则

一 、房屋征收主体及实施单位    

(一)房屋征收主体:清流县人民政府

    (二)房屋征收部门:清流县住房和城乡建设局

(三)房屋征收实施单位:清流县龙津镇人民政府

二、 房屋征收范围及对象

(一)房屋征收范围:东至长兴中街,南至原长途客运站宿舍楼、民宅,西至检察院宿舍楼,北至城西路(具体范围以征收红线图为准),征地面积约19776㎡,建筑面积约 21478 ㎡。

(二)房屋征收对象:本方案所适用的被征收人为纳入“清流县原县长途客运站-建筑公司片区改造项目红线图”范围内的所有被征收人。

三、征收方式

本项目采取预征收方式实施,待清流县人民政府发布征收决定后,已签订的预征收协议转为正式协议。

四、征收补偿安置方式

(一)住宅、商业店面采用产权调换和货币补偿两种方式,被征收人可以自由选择其中一种补偿安置方式。其它用途的建(构)筑物原则上采用货币补偿方式。

(二)征收下列情形的房屋一律实行产权调换:

1.被征收人住宅的共有人对安置方式的选择未达成一致意见的。

2.房屋产权有纠纷,权属不清或产权人下落不明的。

3.房屋抵押权人和抵押人未重新设立抵押权或抵押人未清偿债务的,但被征收房屋已进入法院执行阶段的除外。

4.房屋存在被抵押或查封的情形。

(三)杂物间一律采用货币补偿方式。无权属证书或属于单位产权的,砖木结构给予150/㎡补偿,砖混结构给予200/㎡补偿;有权属证书或有房屋行政主管部门出具购房发票的,购房原始发票遗失的,凭权属证书或房屋行政主管部门出具的有效证明,按500/㎡给予补偿。商品房交易购买的底层架空层杂物间按800/㎡给予补偿。

五、安置地点

(一)现房安置点:现房安置点4处共计14套(详见附表二现房安置点情况表)。选择现房安置的,其中永顺花园5#502室的给予被征收人已认定原房屋有效面积5%的现房面积奖励,其他房源给予被征收人已认定原房屋有效面积10%的现房面积奖励。超面积部分按市场评估价格计算(见附表二)。临时安置费按已认定原房屋有效面积给予6个月的临时安置费,按10//月计算。

(二)期房安置地点:实行就地就近期房安置,用于产权调换的安置房规划建设在本改造项目红线范围内(具体以规划部门批准的建设方案为准)。

六、征迁期限

征迁期限以清流县人民政府发布的《清流县原县长途客运站-建筑公司片区改造项目房屋征收决定》为准。

 

第二部分 国有土地上住宅、商业店面征收补偿安置办法

一、权属面积认定

(一)被征收人房屋面积的认定:已办理产权登记的房屋,以房屋所有权证记载的面积为准;城西路8号,城西路932号两幢房屋的被征收人房屋产权证因历史原因未含公摊面积的,可根据清流县不动产登记中心认定的面积为有效面积。

(二)被征收房屋为合法建筑,未办理产权登记的房屋,以第三方测量的面积为准。

(三)被征收人在房屋顶楼或露台等加盖的建(构)筑物一律不予认定为有效面积。但能积极配合,可按不同结构的房屋重置价结合成新率给予补助(杂物间不适用于本条款)。(见附表一)

201411日“两违”综合治理专项行动启动后擅自抢建的违章建筑和本方案实施前已经行政执法部门处理的违章建筑,不论年限,原则上不予补偿。

(四)私营企业或个人租用场地建设(新建、加盖)的无产权房屋,不予认定为有效面积。但能积极配合,可按不同结构的房屋重置价结合成新率给予补助(见附表一)。在签约期限内签订协议并搬迁的,给予100/㎡的搬迁奖励。

二、房屋丈量

征收人负责委托有相应资质的测量单位对征收范围地上建(构)筑物进行丈量。地上建(构)筑物建筑面积丈量办法,按照国家颁发的《房产测量规范》(GB/T179861-2000)规定执行。

三、住宅(套房)征收补偿安置办法

(一)货币补偿:以协商方式进行货币补偿。

1.补偿单价:房屋征收部门以已认定原房屋有效面积为基数,按委托评估机构评估确定的4513/协商补偿统一价进行征收

2.临时安置费:按已认定原房屋有效面积给予6个月的临时安置费,按10//月计算。

3.搬迁补助费:按已认定原房屋有效面积一次性发给16/㎡。

4.搬迁奖励:被征收人在公告规定的协商期限内签订协议并按协议约定移交旧房的,按已认定原房屋有效面积给予100/㎡搬迁奖励,超过协商期限不予奖励。

5.整体交房奖励:在公告规定协商期内,该幢被征收人100%签订房屋征收补偿安置协议并在规定的期限内搬迁移交旧房的,每套按已认定原房屋有效面积给予200/㎡整体交房奖励。

6.网线迁移费:按固定电话移机费58元、宽带移户费108元、有线电视移户费380/套、管道燃气移户费按实报销(参照明政办〔2018104号标准)。

7.困难补助费:不论选择货币补偿或产权调换,凡是被征收人经民政部门、残联认定为“五保户、低保户和重度残疾人(一级、二级)”的,给予每户2万元困难补助。

8.二次装修补偿:由房屋征收部门委托评估机构采取评估方式确定旧房装修补偿。

(二)征收个人住宅,被征收人选择货币补偿且符合申请公共租赁住房条件的,住房保障部门在有房源的情况下应当优先给予配租,被征收人可以不轮候。

(三)产权调换:以协商方式进行产权调换。

1.协商方式:

1)以被征收房屋已认定原房屋的有效面积为基数,按套按面积拆一返一,新旧房屋不补差价。

2)在征收协商期限内签订协议并腾房交房的住宅,按已认定原房屋有效面积的10%(最多不超过10㎡)给予新房公摊补偿。

3)已认定的原房屋有效面积加上新房公摊补偿面积为有效面积基数(以下简称总面积)选择上靠安置标准房型。

被征收人选择安置房时,其总面积原则上不得少于安置房面积的50%;确实达不到选择最小户型面积 50 %的,可按最小户型选择安置房。

(4)上靠面积不超过10㎡(含10㎡)的,按2256/㎡优惠价计算;上靠面积超过10㎡(不含10㎡)的部分,按本地块商品房开盘时政府备案价计算。

(5)上靠面积不足5㎡的,不足部分按2256/㎡给予补偿。

(6)选择的安置房面积小于总面积,安置不足面积部分按协商补偿统一价4513/㎡给予货币补偿。

(7)因产权调换安置房的土地性质为出让地,原房屋为划拨土地的被征收人,应按原不动产权证登记的土地使用面积(或清流县不动产登记中心备案应分摊土地使用面积),按现行的地段基准地价10%补交土地出让金。

2.其它补助:

1临时安置费:临时安置费按已认定原房屋有效面积给予10//月计算。过渡期限暂定36个月(临时安置费的发放期限以被征收人的实际临时安置过渡时间为准,即从被征收人按照征收单位的书面搬迁通知并交房之日起至安置房交付之日止),逾期36个月,自逾期之日起,对自行临时安置的被征收人双倍发放临时安置费,对使用征收单位提供周转房的被征收人,按正常标准发放临时安置费。

2搬迁补助费:搬迁补助费按已认定原房屋有效面积一次性发给16/㎡。

3)搬迁奖励:被征收人在公告规定的协商期限内签订协议并按协议约定移交旧房的,按已认定原房屋有效面积给予400/㎡搬迁奖励,超过协商期限不予奖励。

4)整体交房奖励:在公告规定协商期内,该幢(以楼幢为单位)被征收人100%签订房屋征收补偿安置协议并在规定的期限内搬迁移交旧房的,每套按已认定原房屋的有效面积给予200/㎡整体交房奖励。

5)网线迁移费:按固定电话移机费58元、宽带移户费108元、有线电视移户费380/套、管道燃气移户费按实报销(参照明政办〔2018104号标准)。

6)困难补助费:不论选择货币补偿或产权调换,凡是被征收人经民政部门、残联认定为“五保户、低保户和重度残疾人(一级、二级)”的,给予每户2万元困难补助。

7)二次装修补偿:由房屋征收部门委托评估机构采取评估方式确定旧房装修补偿。

3.安置房规划户型:分别约80㎡、100㎡、120㎡、142㎡四种户型(具体以规划审批户型为准)。

4.安置房交房标准:按商品房毛坯房交房标准交付。并按被征收房屋已认定有效面积加上新房公摊补偿面积后给予120/㎡的室内隔墙和卫生洁具补助费。

5.楼层价格调节系数:以安置房总层数的三分之一层为均价层,均价层(三分之一层)以上每增加一层应递增10/㎡,均价层(三分之一层)以下,每减少一层应递减10/

安置房顶层(顶层为复式楼的除外)价格调节系数参照均价层执行,不补楼层差价。

6.安置房经竣工验收合格,被征收人应当按照征收单位的书面通知要求进行选房领房,没有在时限要求内领房的,不再发放过渡费。领房之日起的装修期限为3个月,装修期间的过渡费按正常标准发放。

四、商业店面补偿安置办法

(一)货币补偿:以协商方式进行货币补偿。

1.补偿单价:房屋征收部门以已认定原房屋有效面积为基数,按委托评估机构评估确定的6961/协商补偿统一价进行征收

2.临时安置费:按旧房权属证书记载的有效面积为基数给予6个月的临时安置费,按20//月计算[商业用房临时安置费参考《关于调整清流县机关事业单位经营性资产市场租赁价格的通知》(清财资〔20154号文件)]

3.搬迁补助费:按房屋权属证书记载的有效面积为基数,一次性发给16/㎡。

4.停产停业损失补偿:停产停业损失补偿标准,按合法、有效的相关生产经营行政许可证照,且行政许可证照上载明的住所(营业场所)为被征收房屋;根据经营者近3年平均净利润确定,不足3年的以全部生产经营期间平均净利润确定。净利润根据税务部门出具的税后利润额证明材料确定;税务部门无法出具证明的,根据具备相应资质的会计师事务所出具的企业年度审计报告确定,或按委托评估机构采取评估的方式确定停产停业损失补偿标准。按房屋权属证书记载的有效面积为基数给予6个月的停产停业损失补偿。

5.二次装修补偿:由房屋征收部门委托评估机构采取评估方式确定旧房装修补偿。

(二)产权调换:以协商的方式进行产权调换

1.本项目商业店面实行就地就近期房安置,以被征收房屋权属证书记载的有效面积为基数,在安置地块按套(间)面积拆一返一,超面积部分按本地块商品房开盘时政府备案价计算。不足部分按评估机构评估确定协商补偿的统一价值,按6961/㎡计算。因产权调换安置房的土地性质为出让地,原房屋为划拨土地的被征收户,应按被征收房屋权属证书记载的土地使用面积(或清流县不动产登记中心备案应分摊土地使用面积),按现行地段的基准地价40%补交土地出让金。

2.临时安置费:业用房的临时安置费按旧房权属证书记载的有效面积为基数,按20//月计算[商业用房临时安置费参考《关于调整清流县机关事业单位经营性资产市场租赁价格的通知》(清财资〔20154号文件)]。临时安置期限暂定36个月(临时安置费的发放期限以被征收人的实际临时安置时间为准,即从被征收人按照征收单位的书面搬迁通知并交房之日起至安置房交付之日止),若逾期安置,房屋征收部门从逾期之日起,双倍发放临时安置费。

3.搬迁补助费:按房屋权属证书记载的有效面积为基数,一次性发给16/㎡。

4.停产停业损失补偿:停产停业损失补偿标准,按合法、有效的相关生产经营行政许可证照,且行政许可证照上载明的住所(营业场所)为被征收房屋;根据经营者近3年平均净利润确定,不足3年的以全部生产经营期间平均净利润确定。净利润根据税务部门出具的税后利润额证明材料确定;税务部门无法出具证明的,根据具备相应资质的会计师事务所出具的企业年度审计报告确定。或按委托评估机构采取评估的方式确定停产停业损失补偿标准。按实际停产停业时间计算补偿。

5.二次装修补偿:由房屋征收部门委托评估机构采取评估方式确定旧房装修补偿。

(三)住宅改经营性用房补偿:

本征收项目范围内城西路、长兴中街沿街一层第一自然间实际用于经营的房屋,即将非经营性用房改为经营性用房的,被征收人应提供土地与房屋权属证书,经营性纳税证明,并在规定期限内签订协议与搬迁交房的,参照(明政文[2009]209号)文件精神结合(明政办[2018]104号)文件处理办法,可在房屋原使用性质补偿的基础上,按下列标准再予以适当补助:

1.199041日至1994128日期间取得工商营业执照,征收时实际经营并依法纳税的,补偿金额=经营面积×(假设认定为营业性用房的市场评估单价-按住宅用途的补偿单价)×50%

2.1994129日至20021130日期间取得工商营业执照,征收时实际经营并依法纳税的,补偿金额=经营面积×(假设认定为营业性用房的市场评估单价-按住宅用途的补偿单价)×30%

3.经营面积以市场监督管理部门登记的面积为准,市场监督管理部门档案未登记经营面积的或登记的经营面积大于产权证的建筑面积(不含卫生间、厨房和楼梯间),以实际丈量为准。

五、其它

(一)实行协商期内先签协议先选房的原则,若同一时间段内有多户签订协议,则以摸球形式产生选房顺序号,进行现场集中选房。具体选房办法以房屋征收部门通告为准。

(二)被征收人应当在协议约定的搬迁期限内搬迁,未在约定的期限内搬迁,取消公摊面积补偿和搬迁奖励。

(三)被征收人在移交旧房时须结清水、电、燃气、电话、有线电视等相关费用。

(四)被征收房屋的产权证、土地证或不动产权证书(原件),产权人身份证、户口簿(复印件)须按协议约定时间移交给房屋征收部门,以便办理安置房的权属证明。

(五)领取安置房前,被征收人须办理相关费用结算手续,实行多还少补。逾期未办理的,房屋征收部门有权处置该安置房。

(六)房屋征收部门在完成全部安置工作后12个月内,提供安置房的产权登记申报材料,协助被征收人申办权属证明,办理安置房权属证明的相关税费按国家有关规定各自缴纳。

(七)本方案实行“六公开”制度:(1)房屋产权面积和现场摸底调查核实面积公开;(2)被征收户基本信息与拆迁安置相关信息公开;(3)征收补偿安置方案公开;(4)被征收户补偿安置结果公开;(5)被征收户安置房选房号公开;(6)安置房具体信息公开。以上信息按程序在本地块征迁公示栏公开。

本实施方案未尽事宜,由房屋征收部门与被征收人按相关规定,本着公平合理,切合实际的原则协商解决。
